What the Renters’ Rights Act Actually Changed
The Renters’ Rights Act 2025 represents the most significant overhaul of the private rented sector in a generation. For HMO landlords specifically, the consequences are substantial.
Fines up to £40,000. Failures to comply with HMO licence conditions — including property management obligations around waste — now carry civil penalties of up to £40,000 per breach. These are not rare enforcement outcomes. Local authorities across England have been handed expanded powers and are actively using them.
Rent repayment orders, extended. Tenants can now pursue rent repayment orders covering up to 24 months of rent — double the previous maximum. These orders are increasingly being used as a direct response to poor property management, of which waste and communal area standards are a key trigger.
No-fault evictions, abolished. The removal of Section 21 means you cannot simply move on a problematic situation. Your licence must be clean. Your compliance must be demonstrable. And it must stay that way.
Landlord database registration. To use certain grounds for possession under Section 8, landlords must now be registered on the new Private Landlord Database. That registration puts you on the radar — and any enforcement action against your properties is now far more visible.
The message is unambiguous: the era of informal property management is over. Documentation, compliance and professional standards are no longer optional.
